SPI Medical Imaging: Blame Game: The Future of Liability and Regulation for AI

Published 17/04/2024

In late March, the United States Attorney’s Office for the Southern District of New York announced a $3.1 Million false claims act settlement against The Radiology Group and its CEO for fraudulent billing practices. The settlement resolves claims that the Atlanta-based teleradiology company and its CEO violated the False Claims Act by fraudulently billing federal health care programmes. The US government further alleges that the company and its CEO misrepresented who actually rendered the radiology services when seeking payments and improperly sought reimbursement.

This case raises significant questions related to liability and regulation that will weigh heavily on the medical imaging sector, particularly as AI adoption increases and solution capabilities expand to provide draft reports and step over into the realm of autonomous AI.
